Parking a vehicle is not an easy task.

Drivers suffer especially when the house is located in a densely populated area and does not have a garage, a special place in the controlled parking system or access to a municipal parking lot.

In many cases, drivers create makeshift constructions with chairs, crates, logs, old bicycles and motorbikes, bricks, marble, etc., or voluntarily paint the road red or yellow to “hold” a parking space to park outside without hassle. from home when they return from work. Similar steps are taken by some shopkeepers in order to create conditions of convenience for their customers or for the display of their shop window to passers-by.

This peculiar “parking reservation” on the street, outside a home or business, and without a permit to occupy the roadway or other markings, is prohibited by the Traffic Code and carries fines.

Article 48 of the Code of Civil Procedure states when the occupation of a road and pedestrian section is allowed and when it is prohibited, as follows:

Temporary or permanent occupation of part of the roadway with installations or obstacles shall  be prohibited, in particular if they impede traffic, permitted stopping or parking of vehicles or restrict the visibility of those using the roads.

2.  Except as provided in the preceding paragraph, in exceptional cases or areas of low traffic within residential areas may be permitted, if there is sufficient space for them, the occupation of a section of road with temporary installations or obstacles with the permission of the Municipal or Community Authorities. following the opinion of the competent Police Authorities.

3.  Those who erect buildings in residential areas or perform other works and occupy the entire sidewalk in front of the building or project, are obliged to build an additional sidewalk or take other appropriate measures for the safe passage of pedestrians. By decision of the Minister of Environment, Spatial Planning and Public Works, the details for the implementation of this provision are determined.

4.  When the occupation of a section of road is allowed, as above, they must be marked by the one who occupied it, according to the provisions of article 9 of this Code.

5.  The occupation of a sidewalk surface for any use other than that which has been constructed, is prohibited, if the traffic of pedestrians is obstructed, as well as the entry-exit of vehicles of urgent need or service of the lanes.

6.  The one who violates the provisions of this article is punished with an administrative fine of four hundred (400.00) euros.
